3 Convicted Individuals in Major Mahama's Killing to Challenge Life Imprisonment Verdict

The lead counsel representing three of the 12 individuals sentenced to life imprisonment for the killing of Major Maxwell Mahama has made it known that his clients intend to contest their conviction.

Theophilus Kafui Donkor, the legal representative, indicated firmly that his clients are convinced the judge misdirected the jury, potentially influencing the verdict against them. As a result, they have instructed him to elevate the case to a higher authority through an appeal.

In an interview on JoyFM’s Newsnight, Donkor conveyed his clients' dissatisfaction with the judge's directions to the jury, underlining their intention to challenge the court's decision through an appeal. He declared, “My clients are not satisfied with the decision of the court and they indeed are going to challenge it on appeal. They believe strongly that they have a good case in this matter. So, I think the three wise men will decide otherwise in their favour.”

Central to this decision to appeal is the argument that the judge failed to properly direct the jury on the applicable law during the determination of the case's verdict. Donkor emphasized that they would consolidate various ongoing appeals into a composite appeal, with the primary ground being the inadequate direction provided to the jury.

Citing the case of Yirenkyi versus the Republic, Donkor highlighted the fundamental requirement to prove a prior agreement in conspiracy charges. He emphasized that in this particular case, the prosecution failed to present evidence demonstrating such a prior agreement among the convicted individuals, despite suggesting a collective plan to carry out the violent act.

Furthermore, he pointed out that despite the claim that all 14 individuals had conspired in a meeting to plan the killing, two of them were acquitted. This, he argued, supports his belief in a favorable outcome on appeal.

As the legal process unfolds, the 12 convicted individuals have initiated their sentence at Nsawam Prison in the Eastern Region.

This development comes following the tragic death of Major Maxwell Mahama, who was killed by an enraged mob at Denkyira Obuase in the Central Region while on official duty as a detachment commander.
